Our Condemnation Attorneys won a landmark inverse condemnation case against the N.C. Department of Transportation (Kirby v. N.C. Dept. of Transportation, 786 S.E.2d 919). The case was won 3-0 at the N.C. Court of Appeals level and 7-0 at the N.C. Supreme Court. These Map Act cases are now being fought at the trial level.

The firm is actively engaged in property rights actions and eminent domain litigation, specifically actively asserting the inverse condemnation and constitutional rights of hundreds of North Carolina property owners in ongoing lawsuits against North Carolina Department of Transportation (NCDOT) in the Kirby related Map Act cases. Hendrick Bryant’s fight in the court system resulted in the Map Act statute being repealed after being on the books for 28 years.
